DON'T FORGET THE UCC SEARCH:
As a piece of real property is subject to a
title search, systems and equipment and
sometimes inventories are subject to a UCC
search. If you place a lien or notice
against a business system or equipment, the way
to enforce your lien is by filing under the
Uniform Commercial Code (UCC). This filing
serves as a public notice of the lien, and title
to the assets filed against should not be
transferred without contacting the filers.
If you take title without the UCC search, you
may wind up without any title at all. Your
attorney can arrange for this to be done.
